We can review many different types of decisions made under Commonwealth and Norfolk Island laws. Reviews are dealt with in one of the AAT’s eight Divisions.  How you apply for review varies depending on the type of decision you want reviewed.

Centrelink decisions

Social Services & Child Support Division

We can review many decisions made by an officer of the Department of Human Services (Centrelink) that have been reviewed internally, usually by an Authorised Review Officer. This includes decisions about social security payments, family assistance payments, paid parental leave and student assistance payments.

General Division

If you are dissatisfied with a decision made by the Social Services & Child Support Division about a Centrelink decision, you can apply to us for a second review (except an employer-related paid parental leave decision).

Child Support decisions

Social Services & Child Support Division

We can review many decisions made by an officer of the Department of Human Services (Child Support) that have been reviewed internally, usually by a Child Support Objections Officer.

General Division

We can review certain decisions made by an officer of the Department of Human Services (Child Support) about departure prohibition orders and departure authorisation certificates.

Also, if you are dissatisfied with one of the following types of decisions made by the Social Services & Child Support Division, you can apply to us for a second review:

  • a decision to refuse an extension of time to apply for a review
  • a decision relating to a party's percentage of care for a child.

Migration and Refugee decisions

Migration & Refugee Division

We can review most decisions made by the Department of Immigration and Border Protection under the Migration Act 1958:

  • to refuse or cancel a visa
  • relating to approval and cancellation of sponsorship and nomination.

General Division

We can review decisions of the following kind made by the Department of Immigration and Border Protection under the Migration Act 1958:

  • to cancel a business visa under section 134
  • to refuse or cancel a visa based on character grounds (including under sections 5H(2), 36(1C), 36(2C) and 501)
  • to not revoke a mandatory visa cancellation under section 501CA.
