Jurisdiction
The AAT does not have a general power to review decisions made under Commonwealth legislation. The AAT can only review a decision if an Act, Regulation or other legislative instrument specifically provides that the AAT can review the decision.
The AAT maintains a list of the enactments under which decisions may be made that the AAT can review. The list includes a brief description of the decisions that the AAT can review. The list is called the Jurisdiction List.
Time limits
The general rule is that an application for review of a decision must be made to the AAT within 28 days after the day on which the person is given the reviewable decision: section 29(2) of the Administrative Appeals Tribunal Act 1975. However, this time limit can be varied, most often by the enactment pursuant to which the reviewable decision was made. The Time Limits List outlines these variations.
